Annexation Plan

 

 

STATE OF TEXAS
COUNTY OF BELL

WHEREAS, each municipality shall adopt an annexation plan as required by Section 43.052, Local Government Code, on or before December 31, 1999, that becomes effective December 31, 1999; and

WHEREAS, the annexation plan shall specifically identify annexations that may occur beginning on the third anniversary of the date the annexation plan is adopted; and

WHEREAS, any area in the city's extra-territorial jurisdiction (E.T.J.) may continue to be annexed, subject to the procedures of Chapter 43 Subchapter C-1 of the Local Government Code, without being included in the annexation plan if :
  • the area contains less than 100 residentially developed tracts; or
    fifty percent or more of land owners of the area petition to be annexed; or
  • the city determines annexation is necessary to protect the area or the city from imminent destruction of property or injury to persons; or
  • the city determines annexation is necessary to protect the area or the city from conditions that constitute a public or private nuisance.

NOW, THEREFORE, BE IT RESOLVED that this resolution shall serve as the Annexation Plan for the City of Harker Heights, Texas and that no areas within the city's one mile E.T.J. shall be identified for annexation beginning on the third anniversary from the date of this resolution.
