Consent Items:
Smith made the motion to approve Consent Item # 1. Seconded by Christ. All in favor. Motion approved 5-0.
1. The Council approved the minutes of the meeting held July 13, 2010 and July 20, 2010.
Public Hearings:
1. The Council conducted a Public Hearing to discuss and consider the environmental impact of Purser Family Park Project in the floodplain. Jerry Bark, Parks and Recreation Director made the presentation.
2. The Council conducted a Public Hearing to discuss and consider approving a resolution of the city of Harker Heights, Texas, as hereinafter referred to as “Applicant”, designating certain officials as being responsible for, acting for, and on behalf of the Applicant in dealing with the Texas Parks & Wildlife Department, hereinafter referred to as the “Program”; certifying that the Applicant is eligible; dedicating the proposed site for permanent public park and recreational uses; and certifying that the application has been submitted to the appropriate Regional Council of Governments for the Texas Review and Comment System (TRACS) review. Jerry Bark, Parks and Recreation Director made the presentation. Murphey made the motion to approve. Seconded by Reider. All in favor. Motion approved 5-0.
New Business:
1. The Council discussed and considered approving a resolution of the City of Harker Heights, Texas, resolving to prevent mining and drilling on City property being utilized for a Texas Parks and Wildlife Development Project. Jerry Bark, Parks and Recreation Director made the presentation. Christ made the motion to approve. Seconded by Robinson. All in favor. Motion approved 5-0.
2. The Council discussed and considered approving a resolution awarding a contract for a sidewalk extension on FM 2410 from Indian Trail to the existing sidewalk and from the existing sidewalk west of the 2410 Community Park which leads to Harker Heights High School. Mark Hyde, Public Works Director made the presentation. Christ made the motion to approve. Seconded by Murphey. All in favor. Motion approved 5-0.
3. The Council discussed and considered approving an ordinance amending the existing Gas Franchise between the City and ATMOS Energy Corporation to provide for a different consideration; providing for an effective date; and providing for acceptance by ATMOS Energy Corporation. Alberta Barrett, Finance Director made the presentation. Reider made the motion to approve. Seconded by Smith. All in favor. Motion approved 5-0.
Presentation by Citizens:
1. The Council received and discussed a presentation from Harker Heights Citizen Frank Martino, 2001 Rose Circle, Harker Heights, Texas, regarding getting second notices for his water bill but not getting the original bill. No action taken.
2. Harker Heights Citizen Eddie Witherspoon, 809 S. Ann Blvd., Harker Heights, Texas, was not at the meeting to make his presentation regarding being denied the opportunity to display sales items outside of his store.
Reports of Advisory Boards & Commissions:
The Reports of the Advisory Boards & Commissions were taken out of order. The Harker Heights Chamber Report was pulled from third to first.
1. Receive and discuss a presentation from Bill Kozlik with the Harker Heights Chamber of Commerce regarding updates on the Chamber and Ted Smith made a presentation regarding updates to the Food and Wine Festival. No action taken.
2. The Council received and discussed a presentation from Mr. Robert Ator with Hill Country Transit Authority regarding updates to the HOP and funding request. No action taken.
3. The Council received and discussed a presentation from Mr. Charles with the Boys and Girls Clubs of Central Texas regarding a funding request. No action taken.
Items from Council:
1. The Mayor advised everyone that he attended a plasma furnace demonstration that was very informative.
2. The Mayor congratulated the Parks and Recreation Department on a job well done on the dedication to Andy Anderson with a living legacy tree.
Staff Reports:
1. The Council received and discussed the third quarter Investment Report for Fiscal Year 2009-10. Alberta Barrett, Finance Director made the presentation. No action taken.
2. The Council received and discussed the City Manager’s Report. Steve Carpenter, City Manager made the presentation. No action taken.
Closed Meeting:
1 At 6:48 p.m. the Mayor announced a closed meeting for the following purposes:
A) Pursuant to §551.087 of Texas Government Code to deliberate regarding commercial or financial information that the City Council has received from a business prospect that the governmental body seeks to have locate, stay, or expand in or near the territory of the governmental body and with which the governmental body is conducting economic development negotiations on property located in the general area of the US 190 corridor between Rosewood Retirement Center and The Shops at Modoc.
B) Pursuant to §551.087 of Texas Government Code to deliberate regarding commercial or financial information that the City Council has received from a business prospect that the governmental body seeks to have locate, stay, or expand in or near the territory of the governmental body and with which the governmental body is conducting economic development negotiations on property located in the general area of FM 2410 and Verna Lee Blvd.
1. At 7:13 p.m. the Mayor reconvened the open meeting to take action as appropriate on matters discussed in the closed meeting.
A) No action taken.
B) No action taken.
